AFFIDAVIT OF ELIGIBILITY AND PUBLICITY AND LIABILITY RELEASE GREENLIGHT® “GOAL GET 'EM” SWEEPSTAKES

As a reminder, only Entrants that are authorized account holders of the Instagram account (in the case of the Instagram Entry Method) or are at least 18 years of age (in the case of a Mail In Entry Method), will be eligible to become a Prize Winner. Any capitalized, undefined terms appearing in this Affidavit will have the meanings ascribed to them in the Official Rules for the Greenlight® “Goal Get 'Em” Sweepstakes which are available at: https://greenlight.com/goal-get-em-sweepstakes

In connection with the Greenlight® “Goal Get 'Em” Sweepstakes (the “Sweepstakes”), the undersigned hereby certifies, represents, warrants to and agrees with the following.

1. I acknowledge that I have read the Sweepstakes’ Official Rules and agree to be bound by the same. Any capitalized terms not defined herein have the meaning ascribed to them in the Sweepstakes’ Official Rules.

2. I hereby certify that I am a resident of the United States (which, for purposes of the Sweepstakes shall be deemed to include the 50 United States and the District of Columbia, and to exclude Puerto Rico and all United States territories and possessions) and am 18 years of age or older at the time of my entry. I have complied with all of the rules and regulations of this Sweepstakes and have perpetrated no fraud or deception in connection with the Sweepstakes. I also understand that I am solely responsible for payment of any applicable taxes, fees and incidentals.  I also understand that the Sponsor may, in its sole discretion, withhold from the amount of any Prize any and all federal, state, and local tax liabilities and any applicable fees associated with accepting a Prize or Participation in the Sweepstakes.

3. As a condition of acceptance of the applicable Prize, I hereby agree to release, discharge, indemnify and hold harmless Greenlight Financial Technology, Inc. (“Sponsor”), Community Federal Savings Bank (“CFSB”) and their respective affiliates, subsidiaries, parent companies, and holding companies, and their respective officers, directors, shareholders and principals, employees, representatives, and agents (collectively, “Released Parties”), from and against any claims made by me or any other third parties related in any way to the operation of the Sweepstakes, as well as any other claims, damages or liability due to any injuries, damages or losses (whether alleged, threatened, or actual) to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from (i) participation in the Sweepstakes; (ii) injuries which I might sustain incident to any participation in the Sweepstakes; (iii) my acceptance, possession, misuse or use of any part of a Prize; or (iv) participation in any Sweepstakes-related activity. I further acknowledge and agree that the Sweepstakes and the Prizes are provided “as is” without warranty, representation, guarantee or condition of any kind, express, implied, statutory or otherwise, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement, unless prohibited by law.

4. By entering this Sweepstakes, I grant Sponsor and CFSB and their agents’ permission to use my name, city/state of residence, picture, biographical information, statements, social media handle, voice and likeness in any advertising and publicity Sponsor and its respective successors, assigns and licensees may conduct relating to the Sweepstakes in any media or format, whether now known or hereafter developed, including but not limited to the Internet, at any time or times in perpetuity, without further compensation or notice, and I hereby release the Released Parties from any liability with respect thereto. You acknowledge that you have no right to approve the advertising or promotional materials created pursuant to this release.

5. I certify that I have executed and completed this Affidavit within ten (10) days of the date notice was delivered by the Sponsor as evidenced by the date set forth on the written Prize award notice or email delivery date (the “Notification Date”). I also understand that if this Affidavit is not returned to Sponsor within ten (10) days of the Notification Date, Sponsor reserves the right to select another winner and I forfeit the applicable Prize. I agree that this Affidavit and Release operates to the benefit of the Released Parties and is binding on me and my heirs, successors and assigns. I attest that I have read the Affidavit and Release, or have had it read to me, and I understand all of the foregoing provisions of this Affidavit and Release, prior to its execution, and agree to be bound by them.
