Hardware Services Terms of Service

IMPORTANT NOTICE
PLEASE READ THESE GREENLIGHT HARDWARE SERVICES TERMS OF SERVICE CAREFULLY BEFORE USING ANY GREENLIGHT HARDWARE DEVICE, RELATED SERVICES, OR RELATED FEATURES DESCRIBED BELOW. THESE TERMS CONTAIN A BINDING INDIVIDUAL ARBITRATION AGREEMENT AND CLASS ACTION WAIVER IN THE SECTION TITLED “DISPUTE RESOLUTION; CLASS ACTION WAIVER.” THIS AFFECTS YOUR RIGHTS WITH RESPECT TO ANY “DISPUTE” BETWEEN YOU AND GREENLIGHT FINANCIAL TECHNOLOGY, INC. (“GREENLIGHT,” “WE,” OR “US”) AND MAY REQUIRE YOU TO RESOLVE DISPUTES IN BINDING, INDIVIDUAL ARBITRATION, AND NOT IN COURT. PLEASE READ THE DISPUTE RESOLUTION AND CLASS ACTION WAIVER SECTION AND THESE TERMS CAREFULLY BEFORE USING THE HARDWARE SERVICES. IF YOU DO NOT AGREE WITH ALL OF THE TERMS AND CONDITIONS OF THESE TERMS OF SERVICE, YOU SHOULD NOT USE THE HARDWARE SERVICES.
BY CLICKING “I ACCEPT” OR ITS EQUIVALENT OR BY ACCESSING OR USING THE HARDWARE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, DO NOT USE THE HARDWARE SERVICES.
1. Scope and Definitions
Your use of the Greenlight website at greenlight.com (the “Website”), the Greenlight store hosted on Shopify at shop.greenlight.com (the “Greenlight Store”), the Greenlight mobile application for a phone, tablet, or other portable device (the “Application”), the Greenlight Family Hub services, the Greenlight Safe Family services, Greenlight hardware devices, related consumer products, and customer support are subject to your compliance with these Terms.
These Terms are a legally binding agreement between Greenlight Financial Technology, Inc. (“Greenlight,” “we,” “our,” or “us”) and you. They describe the terms under which you may access and use the devices, services, software, features, functions, technologies, and content offered by Greenlight through the Website, the Greenlight Store, the Application, and all related sites and applications, regardless of how accessed (collectively, the “Hardware Services”).
“Application User” means any individual who uses the Website, the Greenlight Store, or the Application to access the Hardware Services, including any individual who uses free services Greenlight makes available from time to time. Unless otherwise specified, “you,” “your,” and “yours” refer to an Application User.
2. Overview and Order of Precedence
The Hardware Services are provided directly through Greenlight. Greenlight is not providing the Hardware Services on behalf of any issuing bank. The Greenlight Store is hosted by Shopify Inc., which provides the online e-commerce platform that allows us to sell products and services to you. Any new features or tools added to the Greenlight Store or the Hardware Services are also subject to these Terms. The headings in these Terms are included for convenience only and do not limit or otherwise affect these Terms.
These Terms include: (a) general terms that apply to all Hardware Services; and (b) additional product-specific terms in Sections 28 and 29 that apply only to the applicable device or service.
Order of precedence: If there is a conflict between the general terms and any product-specific terms, the product-specific terms control for that device or service. If there is a conflict between these Terms and any mandatory device packaging, Quick Start Guide, or other device-level regulatory or safety disclosure included with your device, the packaging, Quick Start Guide, or other device-level disclosure controls solely with respect to that regulatory or safety subject matter.
These Terms govern only the Hardware Services and do not replace or amend any separate terms, account agreements, or privacy notices that apply to other Greenlight products or services.
3. Eligibility
By accessing or using the Hardware Services, you represent and warrant that you are at least 18 years of age. If you are under 18 years of age, you may use the Hardware Services only with express and verifiable parental or legal guardian consent.
If a child under thirteen (13) uses any Hardware Service, the child’s parent or legal guardian must create, maintain, and control the account and provide any consent required for Greenlight to collect, use, or disclose the child’s personal information in connection with the Hardware Services.
By providing consent for a user under 18 years of age, the parent or legal guardian expressly agrees:
to be fully responsible for and exercise oversight of the child’s use of the Hardware Services, including ensuring that such use is always in accordance with these Terms, all documents referenced in these Terms, and all applicable laws;
to be fully responsible and liable for the child’s compliance with these Terms and the child’s use of the Hardware Services; and
to be fully responsible for the disclaimers, waivers, and limitations of liability set out in these Terms on the parent’s or legal guardian’s own behalf and on the child’s behalf.
Anyone under 18 years of age is strictly prohibited from creating an account for the Hardware Services without express, verifiable parental consent.
If you use the Hardware Services on behalf of another person or entity: (a) all references to “you” throughout these Terms include that person or entity; (b) you represent that you are authorized to accept these Terms on that person’s or entity’s behalf; and (c) if you or that person or entity violates these Terms, that person or entity agrees to be responsible to us.
4. Changes to the Terms
We reserve the right to modify all or part of these Terms at any time in our sole discretion. Changes are effective upon posting, are prospective only, and are not retroactive. Your continued use of the Hardware Services or access to the Website, Greenlight Store, or Application after any changes are posted constitutes your acceptance of those changes.
5. General Conditions
Some Hardware Services require purchase of a Greenlight hardware device and, for certain features, an active subscription. If you register for an account, you must provide accurate account information and promptly update that information if it changes. You must maintain the security of your account and promptly notify us if you discover or suspect that an unauthorized person has accessed your account. You are responsible for all actions and activities that occur in connection with your account. We reserve the right to reclaim usernames, including on behalf of businesses or individuals who hold a legal claim, including trademark rights, in those usernames.
Greenlight hardware devices may be available only in limited quantities and may be returned or exchanged only in accordance with the applicable policies referenced in these Terms. We reserve the right, but are not obligated, to limit or refuse sales of the Hardware Services or devices to any person, geographic region, or jurisdiction. We also reserve the right, in our sole discretion, to limit or cancel quantities purchased per person, per household, or per order.
We have made every effort to display the colors and images of products on the Greenlight Store as accurately as possible. We cannot guarantee that your screen’s display of any color will be accurate. All descriptions of products and product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on the Website, the Greenlight Store, or the Application is void where prohibited. Prices for our products are subject to change without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Hardware Services.
6. Software and Firmware Updates
The Hardware Services, including the Application and device software, may require periodic updates, patches, fixes, or upgrades. We may provide these updates automatically or require you to install them. If you do not install or permit required updates, some or all Hardware Services may not function properly or at all.
7. Subscriptions and Billing
Certain Hardware Services require a subscription to access some or all features and functionality. Subscription requirements vary by product: the Family Hub device provides a free tier of service upon activation; additional Family Hub features require a paid Family Hub Plus subscription. The Safe Family device does not include a free tier; a paid subscription is required to access Safe Family features and functionality. By subscribing, you agree to the terms of the applicable subscription plan.
Billing cycle: Subscriptions are billed on a monthly, semi-annual or annual basis, as selected at the time of purchase or plan enrollment, in advance on a recurring basis unless otherwise stated in the applicable plan. Your subscription automatically renews at the end of each billing cycle unless canceled or terminated by either you or Greenlight. You authorize Greenlight to charge your payment method on file for the subscription fees and any applicable taxes.
Automatic renewal: Unless you cancel your subscription before the end of the current billing period, your subscription automatically renews and you authorize Greenlight to collect the applicable subscription fees for the next billing cycle. You may cancel your subscription at any time through the Application settings or by contacting us at support@greenlight.me.
Free trials: If Greenlight offers you a free trial for any subscription plan, the trial period and applicable plan will be described at the time of offer. To begin your free trial, you will be required to provide a valid payment method. Unless you cancel before the end of the free trial period, your free trial will automatically convert to a paid subscription and your payment method will be charged the applicable subscription fee at the then-current rate on a recurring basis. You may cancel at any time before the end of the free trial through the Application settings or by contacting us at support@greenlight.me to avoid being charged. Product-specific free trial terms, including the duration of any free trial, are described in the applicable product-specific terms below.
Changes to subscription plans: Greenlight reserves the right to modify subscription plans or adjust pricing for the Hardware Services or any component thereof at any time, in our sole discretion. Any price changes or material modifications to your subscription plan will be communicated to you in advance by email or another available manner and will become effective at the beginning of the next billing cycle following notice. If you do not want to continue at the new price, you must cancel before the price change takes effect. Your continued use of the Hardware Services after the price change takes effect constitutes your agreement to pay the modified subscription fee.
Cancellation: You can cancel your subscription at any time through the Application settings or by contacting us at support@greenlight.me. If you cancel, your subscription will continue until the end of the current billing cycle, during which time you will retain access to the applicable features. Upon cancellation, you will lose access to subscription features at the end of the billing cycle, and you will not receive a refund for fees already paid, except as required by applicable law.
Refunds: All subscription fees are non-refundable, except as required by applicable law. Device returns are governed by the applicable Return Policy.
8. Return Policy, Warranty Policy, Shipping Policy, and Cancellation Policy
If you are not satisfied with your purchase, your rights to return a device, obtain warranty service, or receive shipping-related information are governed by the applicable policies, which are incorporated into and made part of these Terms:

Any return window, return conditions, refund timing, exclusions, and customer obligations are governed solely by the applicable Return Policy. If there is any conflict between a general statement in these Terms and the applicable Return Policy with respect to returns or refunds, the Return Policy controls.
9. Title and Loss
Title to and risk of loss for devices passes to you upon delivery of the ordered items to the carrier. Delivery lead times vary. All delivery dates are estimates and are not guarantees that the product will be delivered on a specified date. Greenlight will not be liable for any loss or expense you incur as a result of any delay in the delivery of your order. You are responsible for filing any claims with carriers for damaged or lost shipments, subject to applicable law.
10. Feedback
By submitting any information, content, or materials to Greenlight through your access to and use of the Hardware Services (each, a “Submission”), you grant Greenlight a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, transmit, and otherwise process that Submission solely as necessary to operate, provide, maintain, secure, support, and improve the Hardware Services as described in these Terms and the Privacy Statement, and you represent that you are entitled to do so for that purpose.
If you respond to any surveys, contests, or interviews about the Hardware Services, or provide feedback, including creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, “Feedback”), you agree that Greenlight, in its sole discretion, can use that Feedback in any way, including in future enhancements and modifications to the Hardware Services.
You hereby grant to Greenlight and its assigns a perpetual, worldwide, fully transferable, sublicensable, fully paid-up, irrevocable, royalty-free license to use, reproduce, modify, create derivative works from, distribute, and display the Feedback in any manner for any purpose, whether in any media, software, or technology of any kind now existing or developed in the future, without any obligation to provide attribution or compensation to you or any third party. We retain all right, title, and interest (including all copyright, trademark, patent, trade secrets, and other intellectual property rights) in the Hardware Services, the Website, the Greenlight Store, and the Application, as well as our trademarks, service marks, designs, logos, URLs, and trade names displayed in connection with the Hardware Services.
11. Privacy
We take the privacy of your Personal Information seriously. We encourage you to carefully review our Privacy Statement for important disclosures about the ways we collect, use, retain, and share personal data and the choices available to you. Our Privacy Statement is incorporated into and subject to these Terms. Additional product-specific data practices, including data retention periods applicable to Safe Family location data, are described in the product-specific terms below and in our Privacy Statement.
If you also use other Greenlight products or services, including financial products or services, your information also will be subject to the privacy notices, disclosures, account agreements, and other terms applicable to those products or services. Nothing in these Terms replaces or limits any separate privacy notice or disclosure applicable to another Greenlight product or service.
If you are a parent or legal guardian who has authorized a child to use the Hardware Services, you may, subject to applicable law, review, request deletion of, or revoke consent for Greenlight’s further collection, use, or disclosure of your child’s personal information by following the instructions in the Privacy Statement or by contacting support@greenlight.me. If you revoke consent or request deletion, some or all Hardware Services may no longer function.
Greenlight may retain information as required or permitted by applicable law, regulation, legal process, fraud prevention, dispute resolution, billing, security, enforcement of these Terms, or other compliance and operational purposes described in the Privacy Statement.
12. Ownership; Limited License
We retain all right, title, and interest, including all copyright, trademark, patent, trade secret, and other intellectual property rights, in the Hardware Services, the Website, the Greenlight Store, and the Application, including all content, features, functionality, text, graphics, images, icons, software, photographs, videos, illustrations, and the compilation and arrangement of them, as well as our trademarks, service marks, designs, logos, URLs, and trade names displayed in connection with the Hardware Services. You are not granted any right or license to use any of these trademarks without prior written permission.
Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Hardware Services for your own personal, non-commercial use. Any use of the Hardware Services other than as specifically authorized in these Terms, without our prior written permission, is strictly prohibited, will terminate the license granted herein, and violates our intellectual property rights.
13. Beta Services
From time to time, Greenlight may offer Beta Services to you. “Beta Services” means the Hardware Services, or a specific feature of the Hardware Services, that are provided prior to general commercial release and that are designated or presented to you as alpha, beta, experimental, pilot, early access, non-production, or in evaluation.
By accepting, downloading, or using any Beta Services, you understand and acknowledge that the Beta Services are being provided on an “as is” and “as available” basis. Beta Services may contain bugs, errors, and other problems. IN NO EVENT SHALL THE TOTAL LIABILITY OF GREENLIGHT OR ITS AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, OR THIRD PARTY PARTNERS, LICENSORS, OR SUPPLIERS TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THE USE OF BETA SERVICES, WHETHER IN CONTRACT, TORT, WARRANTY, OR OTHERWISE, EXCEED $100 USD. Greenlight is not obligated to provide any maintenance, technical, or other support for Beta Services and may discontinue Beta Services at any time in our sole discretion.
14. Artificial Intelligence and Automated Tools
The Hardware Services may incorporate artificial intelligence, machine learning, or other automated technologies (collectively, “AI Tools”) to provide features such as personalization, recommendations, content generation, or process automation. By using the Hardware Services, you acknowledge and agree to the AI Usage Policy, which is incorporated into and made part of these Terms. AI Tools are continuously developed and may evolve over time. We may introduce, modify, or discontinue AI-related features without prior notice. You remain solely responsible for any decisions, actions, or outcomes that result from your use of AI Tools within the Hardware Services.
When you use chatbot features, interactive voice response features, or AI voice assistant features made available through the Hardware Services, you are not communicating with a human. Greenlight and its third-party vendors may monitor and record those interactions, and related usage information, for the purposes described in the Privacy Statement.
Use of data obtained through Google APIs in connection with Family Hub features is subject to the restrictions described in the Privacy Statement.
15. Conduct
As a condition of your use of the Hardware Services, the Greenlight Store, the Website, and the Application, you warrant that you will not use the Hardware Services or any Greenlight hardware device for any unlawful purpose or any purpose prohibited by these Terms. You are solely responsible for your conduct while using the Hardware Services.
You understand, agree, and acknowledge that you may not, and will not, directly or indirectly:
use the Hardware Services for any illegal, harmful, unauthorized, or otherwise prohibited purpose, or to encourage or promote violations of these Terms or any applicable laws or regulations;
misuse or abuse the Hardware Services to stalk, harass, intimidate, threaten, or otherwise harm any person;
attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Hardware Services, including any servers, networks, or databases connected to them;
interfere with, alter, impair, or disrupt the integrity, performance, or normal functioning of the Hardware Services, or otherwise prevent or inhibit other users from fully enjoying the Hardware Services;
impersonate any person or entity, post on behalf of another, or otherwise falsify or misrepresent your identity, affiliation, location, or data in order to mislead others;
use or attempt to use another user’s account without proper authorization;
share, disclose, distribute, or otherwise exploit another person’s personal data or location data without their explicit consent or other legally required authorization;
send, post, or distribute spam, unsolicited or bulk commercial communications, chain letters, pyramid schemes, or similar materials;
transmit, upload, or distribute viruses, malware, or any other harmful, disruptive, or malicious code;
copy, reproduce, distribute, publicly perform, or publicly display any part of the Hardware Services, except as expressly authorized by Greenlight or its licensors;
modify, alter, remove proprietary notices from, or create derivative works based on the Hardware Services;
reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Hardware Services, or bypass, circumvent, or disable any technical or security measures employed to restrict access to the Hardware Services;
scrape, crawl, mine, or use automated data-gathering or extraction methods with respect to the Hardware Services without Greenlight’s prior written consent;
develop, use, or distribute any applications, integrations, or software that interact with the Hardware Services without Greenlight’s prior written consent;
infringe, misappropriate, or otherwise violate the rights of Greenlight, other users, or any third parties, including intellectual property, privacy, or other proprietary rights;
engage in any fraudulent, deceptive, manipulative, or commercially exploitative activity in connection with the Hardware Services; or
disable, circumvent, or otherwise interfere in any way with Greenlight’s security-related features.
Any violation of this section may result in suspension or termination of your access to the Hardware Services in Greenlight’s sole discretion, and in some cases, legal action. Any failure to enforce this section in some instances does not constitute a waiver of our right to enforce it in other instances. This section does not create any private right of action on the part of any third party.
16. Errors, Inaccuracies, and Omissions
Occasionally there may be information on the Website, the Greenlight Store, the Application, or within the Hardware Services that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Hardware Services, the Website, the Greenlight Store, the Application, or any related site is inaccurate at any time without prior notice, including after you have submitted your order.
17. Warranty / Disclaimer of Warranty
Except for the rights granted to consumers under the applicable Limited Warranty provided in accordance with the applicable Warranty Policy, and except to the extent prohibited by applicable law, your use of the Hardware Services is at your sole risk.
Except as otherwise provided in writing by us, the Hardware Services and any content made available through them are provided “as is” and “as available,” without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.
Greenlight makes no representation or warranty regarding the accuracy, timeliness, reliability, or completeness of any data or information provided by the Hardware Services, including notifications, alerts, location information, content synchronization, AI-generated outputs, or any other features. Greenlight disclaims any responsibility for errors, omissions, interruptions, delays, defects, viruses, or other harmful elements that may occur or be transmitted in connection with your use of the Hardware Services. Greenlight does not represent or warrant that the Hardware Services will be free from bugs, security breaches, or other technical problems, and assumes no liability for any damage to your device, system, or data as a result of your use of the Hardware Services. Greenlight does not guarantee that the Hardware Services will be compatible with all devices or that they will function without disruptions, delays, or imperfections under all circumstances.
Functionality of the Hardware Services depends on factors outside Greenlight’s control, including your equipment, device settings, internet service, cellular service, local network connectivity, third-party services, and other communication networks. You assume the entire risk as to the quality and performance of the Hardware Services. Greenlight may remove the Hardware Services for indefinite periods of time or cancel the Hardware Services at any time, without notice to you. You expressly agree that your use of, or inability to use, the Hardware Services is at your sole risk.
Nothing in these Terms excludes, limits, or disclaims any warranty, remedy, or other right that cannot be excluded, limited, or disclaimed under applicable law. If you are a consumer residing in a jurisdiction that does not permit certain warranty disclaimers or limitations, some of the disclaimers or limitations in these Terms may not apply to you. For consumers in California, these Terms do not limit any rights or remedies that cannot be waived under applicable law, including the Song-Beverly Consumer Warranty Act.
18. Promotional Programs
Greenlight may from time to time offer loyalty, award, or promotional programs (“Promotional Programs”) to users of the Hardware Services, including referral programs, advocate programs, and sweepstakes programs. If you participate in any Promotional Program, the following additional terms apply. At our discretion, Greenlight may permit, limit, suspend, or terminate your participation in any Promotional Program at any time.
If you participate in a Promotional Program, you agree to do so in accordance with these Terms, any additional terms related to the specific promotion, and all applicable laws and regulations. In your communications with anyone regarding the Hardware Services, you may not directly or indirectly state or imply that you are an employee, intermediary, or agent of Greenlight. You agree to contact only individuals who have given you their consent to be contacted, to participate in Promotional Programs in ways that respect the privacy of others, and to communicate truthfully about the Hardware Services.
A. Referral Programs
Greenlight may offer a referral program to certain users. A referral program is an opportunity for you to promote and refer the Hardware Services to potential customers with the intent that those customers will themselves start using the Hardware Services. Any individual referred by you becomes a referred customer only if that individual has not previously entered into an agreement with Greenlight for the applicable Hardware Services and has not been previously referred or introduced to Greenlight by another Greenlight customer.
Unless the terms and conditions of a specific referral program provide otherwise, a referred customer is considered accepted only once the referred customer successfully completes the registration process, receives the applicable Hardware Services for at least thirty-five (35) calendar days, and you pay at least one monthly subscription fee, if a subscription is required for the applicable program. Greenlight may refuse to accept any referred customer at its sole discretion. You must properly disclose your relationship with Greenlight and any potential referral reward in your communications with referred customers.
B. Advocate Programs
An advocate program is an opportunity for certain users to engage directly with Greenlight and other Greenlight users, complete challenges designed by Greenlight, and earn rewards or benefits. Invitations to join an advocate program are extended by Greenlight from time to time. Your participation in an advocate program does not guarantee receipt of any associated benefits. Benefits are subject to change at any time and are provided at Greenlight’s sole discretion.
C. Sweepstakes Programs
Greenlight may offer sweepstakes from time to time in order to promote or encourage the use of the Hardware Services generally or specific product features. All sweepstakes prizes will be awarded by random drawing from among eligible entrants. In addition, all federal, state, and local tax liabilities and any applicable fees associated with accepting a prize are the sole responsibility of the winner.
19. Electronic Communication
A. Consent to Receive E-Communications
By accepting these Terms and using the Hardware Services, you consent to receiving electronic communications, which include any disclosure, notice, agreement, statement, schedule of fees, explanation of services, inquiry response, or other communication regarding any account, product, or service provided to you by Greenlight, including Promotional Programs (collectively, “E-Communications”).
B. Email Addresses and Mobile Devices
You agree that we may provide E-Communications to you by email, by text message to a designated mobile device, by posting them to the Website, or by delivering them to you through the Application. E-Communications sent by email will be delivered to the email address registered to your Greenlight account. If an E-Communication sent by email is returned as undelivered, we may use any other email address we have for you or deliver the E-Communication to you through the Application. You must notify us of any change in your email address or mobile device number by emailing support@greenlight.me. Unless otherwise required by law, you agree that any E-Communication is deemed received by you when sent by any of the means described above.
C. Withdrawal of Consent
You may withdraw your consent to receive E-Communications by contacting Greenlight at support@greenlight.me. Withdrawal of your consent to receive E-Communications will result in the immediate closing of your account and cessation of all related Hardware Services.
D. Printed Copies
By accepting these Terms, you consent to receive all communications from Greenlight electronically, including by email or through the Application. You have the right to receive a paper copy of any electronic communication by contacting support@greenlight.com. You may withdraw your consent to electronic communications at any time by contacting us, but withdrawal will result in termination of your account. To access electronic communications you need a device capable of accessing the internet and displaying PDF files.
E. System Requirements
To access and retain your E-Communications, you must have: (i) a personal computer or mobile device capable of accessing the internet, displaying visual content, and sending and receiving emails; (ii) access to a printer if you want paper records; (iii) sufficient device or cloud-based storage capability if you want to retain electronic records; (iv) an internet browser that supports 128-bit encryption; and (v) software capable of accurately displaying PDF files. For E-Communications provided in PDF format, Adobe Acrobat Reader 6.0 or later is required, a free copy of which may be obtained at www.adobe.com. If any of these system requirements change and we believe that the change creates a material risk that you will be unable to access E-Communications, Greenlight will notify you of the new hardware or software requirements.
F. Telephone and Text Communications
By using the Hardware Services and accepting these Terms, and the SMS Terms if applicable, you agree that we may call or send text messages to you regarding your account using any contact information relating to your account, including any telephone number: (i) you have provided to us; (ii) from which you have called us; or (iii) that we obtained and at which we reasonably believe we can reach you. You agree that we may call or text any of these telephone numbers using an automatic telephone dialing system or an artificial or prerecorded voice. You agree to promptly notify us if you change any telephone number you provide to us.
We may offer you the option to receive SMS or text messages, sometimes on a recurring basis, such as messages or alerts related to a monitoring feature, device feature, or service feature of the Hardware Services. You agree that the mobile number you provided is true and accurate and that you are authorized to enroll the designated mobile number to receive such text messages. We are not responsible for delays in sending or receiving text messages. Product-specific SMS alert types are described in the applicable product-specific terms below.
20. Indemnification
You agree to defend, indemnify, and hold harmless Greenlight, its officers, directors, agents, affiliates, subsidiaries, joint ventures, licensees, employees, shareholders, and any third-party partners from and against all damages, expenses, losses, costs, and other claims or demands, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law or regulation, or your violation of the rights of any third party.
21. Limitation of Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, GREENLIGHT (INCLUDING OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS), OUR AFFILIATES, SUBSIDIARIES, AND SERVICE PROVIDERS WILL NOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY, INCLUDING, BUT NOT LIMITED TO, CLAIMS ARISING FROM OR RELATED TO: DELAYS OR MISTAKES RESULTING FROM ANY CIRCUMSTANCES BEYOND OUR CONTROL, INCLUDING, WITHOUT LIMITATION, ACTS OF GOVERNMENTAL AUTHORITIES, NATIONAL EMERGENCIES, INSURRECTION, WAR, OR RIOTS; LOSS OF PROFITS, DATA, GOODWILL, OR ANY OTHER INTANGIBLE LOSSES; THE FAILURE OF MERCHANTS, CARRIERS, OR THIRD PARTIES TO PERFORM OR PROVIDE SERVICES; COMMUNICATION SYSTEM FAILURES OR ANY FAILURES OR MALFUNCTIONS ATTRIBUTABLE TO YOUR EQUIPMENT, INCLUDING YOUR MOBILE PHONE, GREENLIGHT FAMILY HUB DEVICE, GREENLIGHT SAFE FAMILY DEVICE, OR OTHER DEVICE, ANY INTERNET SERVICE, ANY MOBILE PHONE NETWORK, OR ANY OTHER COMMUNICATION NETWORK.
WITHOUT LIMITING THE FOREGOING, IF WE ARE HELD LIABLE FOR DAMAGES TO YOU IN A COMPETENT LEGAL PROCEEDING, YOU WILL BE ENTITLED TO RECOVER ONLY YOUR ACTUAL DAMAGES. IN NO EVENT WILL YOU BE ENTITLED TO RECOVER ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXTRAORDINARY, EXEMPLARY, OR PUNITIVE DAMAGES, WHETHER IN CONTRACT, TORT, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS PROVISION WILL NOT BE EFFECTIVE TO THE EXTENT OTHERWISE REQUIRED BY LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, YOUR RECOVERY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE HARDWARE SERVICES, REGARDLESS OF THE FORM OF ACTION, WILL BE LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID GREENLIGHT IN THE SIX MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
NOTWITHSTANDING THE FOREGOING OR ANYTHING TO THE CONTRARY IN THESE TERMS, IN NO EVENT SHALL THESE TERMS CONSTITUTE A WAIVER OR LIMITATION OF ANY RIGHTS THAT YOU MAY HAVE UNDER FEDERAL OR STATE SECURITIES LAWS TO PURSUE A DIFFERENT REMEDY IF AND TO THE EXTENT SUCH RIGHTS CANNOT BE WAIVED OR LIMITED.
22. Dispute Resolution; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT MAY SIGNIFICANTLY AFFECT YOUR RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT OR TO PURSUE CLAIMS IN A CLASS OR REPRESENTATIVE CAPACITY.
A. Applicability
These Terms are governed by the Federal Arbitration Act and federal arbitration law. To the fullest extent allowed by applicable law, you and Greenlight agree to submit all Disputes between us to individual, binding arbitration pursuant to the provisions in this section. A “Dispute” means any dispute, claim, or controversy, except those specifically exempted below, between you and Greenlight that in any way relates to or arises from any aspect of our relationship, including your use or attempted use of the Hardware Services (including the Family Hub device, the Safe Family device, and all related services), your account, your relationship with us, and all matters relating to or arising from these Terms, Greenlight’s Privacy Statement, or any other agreement between you and Greenlight, including the validity and enforceability of this agreement to arbitrate. A Dispute is subject to binding individual arbitration regardless of whether it is based in contract, statute, regulation, ordinance, tort (including fraud, misrepresentation, fraudulent inducement, or negligence), or any other legal or equitable theory, including claims that accrued before you entered into these Terms. You understand that there is no judge or jury in arbitration and that court review of an arbitration award is limited.
B. Informal Negotiation Period
Greenlight’s customer support department is available at 1-888-483-2645 or support@greenlight.me to address concerns you may have regarding the Hardware Services or your account. Most concerns are quickly resolved in this manner. In an effort to accelerate resolution and reduce the cost of any Dispute between us, you and Greenlight agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before either party initiates arbitration or court proceedings. This period begins upon receipt of written notice from the party raising the Dispute.
If Greenlight has a Dispute with you, it will send notice to your billing address or email address you have provided to us. If you have a Dispute with Greenlight, you must notify us in writing at support@greenlight.me using the subject line “Initial Dispute Resolution Notice.” Your notice of Dispute must be individual to you and must include: (i) your name; (ii) the email address associated with your account; (iii) your cell phone number; (iv) your residential mailing address; (v) a description of the Dispute; (vi) the facts of the Dispute as you understand them; and (vii) the relief you seek. A notice of Dispute containing all required information, followed by at least thirty (30) days of good-faith negotiation, are preconditions to either party initiating a lawsuit or arbitration.
C. Binding Arbitration
If a Dispute cannot be resolved through negotiations during the informal negotiation period, then either you or Greenlight may elect to have the Dispute finally and exclusively resolved by binding arbitration, unless an exception stated below applies. The arbitration will be administered by the American Arbitration Association (“AAA”) in accordance with the AAA Consumer Arbitration Rules in effect when the notice of Dispute is delivered to the other party, as modified by these Terms. If AAA is unable to provide the arbitration, then you may file your Dispute with any national arbitration company that handles consumer arbitrations using procedures substantially similar to the AAA rules.
If the amount of a Dispute does not exceed $25,000, the Dispute may be resolved by the arbitrator through submission of documents only, without in-person or telephonic hearings. Any party may still request a hearing, and the arbitrator may determine that a hearing is necessary. Arbitration hearings may be conducted by videoconference unless the arbitrator believes an in-person hearing is necessary. The arbitrator will make a decision in writing and must follow applicable law. The decision of the arbitrator is final and binding on you and Greenlight, and any award of the arbitrator may be entered in any court of competent jurisdiction. The arbitrator shall determine the scope and enforceability of this arbitration agreement. If a lawsuit filed in court includes both arbitrable and non-arbitrable claims, you and Greenlight agree that any non-arbitrable claims shall be stayed pending the completion of the arbitration.
D. Class and Collective Action Waiver
TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, YOU AND GREENLIGHT AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER PARTY ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A CLASS ACTION, COLLECTIVE ACTION, CLASS ARBITRATION, OR PRIVATE ATTORNEY GENERAL ACTION. To the extent applicable law does not permit waiver of private attorney general claims, but permits them to be arbitrated, then such claims shall be resolved in arbitration. If any provision in this Dispute Resolution; Class Action Waiver section is found to be unenforceable, that provision shall be severed, with the remainder of this section remaining in full force and effect. If the prohibition against class or collective actions is found to be unenforceable for any reason, then this entire Dispute Resolution; Class Action Waiver section shall be null and void.
E. Exceptions to Informal Negotiations and Arbitration
Notwithstanding the parties’ decision to resolve all Disputes through arbitration, either party may bring an action in state or federal court that only asserts claims for patent infringement or invalidity, copyright infringement, piracy, moral rights violations, trademark infringement, or trade secret misappropriation. Either party also may seek relief in a small claims court for any individual disputes or claims within the scope of that court’s jurisdiction.
F. Thirty-Day Right to Opt Out
You have the right to opt out and not be bound by the arbitration and class action waiver provisions in this section by visiting www.greenlight.com/arbitration/opt-out, printing, completing, and signing the Greenlight Arbitration Opt-Out Form, and mailing the completed form to:

The Arbitration Opt-Out Form requires identifying information sufficient for Greenlight to identify you, your account, any child account attached to your account, and the specific Terms from which you are opting out, including: (i) your full name; (ii) mailing address; (iii) email address; (iv) cell phone number; (v) the last four digits of your Greenlight Prepaid Mastercard Account number, if any; (vi) the URL of the specific Terms of Service from which you are opting out; and (vii) the same information for any child who has been issued a Secondary Account attached to your Primary Account. The completed form must be sent to Greenlight within thirty (30) days of the date on which you first accept these Terms.
G. Arbitration Fees and Expenses
Under the AAA rules, if Greenlight is the claimant making a demand for arbitration, then Greenlight is responsible for paying all administrative fees of the arbitration, including the non-refundable initial filing fees, case management fees, hearing fees, and arbitrator fees charged by the AAA. If you are the claimant, you will be required to pay your portion of the non-refundable initial filing fees, and Greenlight will pay the remainder of the administrative fees. Each party is responsible for its own attorneys’ fees, costs of required travel, and other expenses in connection with any arbitration. The expenses of witnesses for either side shall be paid by the party producing that witness.
23. Choice of Law; Venue for Non-Arbitrable Disputes
Except as otherwise provided in these Terms, your use of the Hardware Services is governed by the laws of the State of Delaware, excluding its conflict of laws provisions, and, where applicable, by the federal laws of the United States. For any claims not subject to binding individual arbitration and that cannot be brought in small claims court, you and Greenlight agree to submit to the exclusive jurisdiction of the state and federal courts in Delaware, and you and Greenlight consent to venue in and personal jurisdiction before those courts, without prejudicing either party’s rights to remove a case to federal court if permissible. Claims excluded from arbitration are subject to the choice of law and forum selection provisions in this section.
24. Notices
Except as expressly set forth otherwise in these Terms, all notices given by you under these Terms must be in writing and addressed to: Greenlight Financial Technology, Inc., 303 Peachtree St. NE, Suite 4300, Atlanta, GA 30308, Attn: Customer Service. Except as expressly set forth otherwise in these Terms, all notices given by Greenlight under these Terms shall be given to you through written notice, email, or posting on the Website or the Application.
25. Termination
The obligations and liabilities of the parties incurred prior to the termination date survive termination of these Terms for all purposes. These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use the Hardware Services, or when you cease using them.
If, in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. We also may deny you access to the Hardware Services, or any part of them.
A breach or violation of these Terms will result in immediate termination of your access to the Hardware Services.
26. Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision nonetheless shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. That determination shall not affect the validity and enforceability of any other remaining provisions.
27. Entire Agreement
The failure of Greenlight to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms and any policies or operating rules posted by Greenlight on the Website, the Greenlight Store, or the Application, or otherwise made available in respect of the Hardware Services, constitute the entire agreement and understanding between you and us and govern your use of the Hardware Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us relating to the Hardware Services. Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
28. Product-Specific Terms for Safe Family
These product-specific terms apply only to the Greenlight Safe Family device and related Safe Family services. In the event of a conflict between these product-specific terms and the general terms above, these product-specific terms control for the Safe Family device and services.
Safe Family Services
The Safe Family services include the Safe Family device and related safety, monitoring, notification, and location-based features Greenlight makes available in connection with that device. Some Safe Family features require an active subscription, compatible devices, network access, and proper account and device setup. The Safe Family device does not include a free tier; a paid subscription is required to access Safe Family features and functionality.
FCC Compliance
The Safe Family device complies with Part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) the device may not cause harmful interference; and (2) the device must accept any interference received, including interference that may cause undesired operation. Changes or modifications not expressly approved by Greenlight could void your authority to operate this equipment. The FCC ID applicable to your device is printed on the device label and in the Quick Start Guide included with your device.
Safe Family Device Regulatory and Safety Information
The Safe Family device is subject to device-specific FCC, radiofrequency exposure, charging, battery, and operating instructions included with the Safe Family device packaging, labeling, and Quick Start Guide. You must use the Safe Family device in accordance with those materials. In the event of any conflict between these Terms and the Safe Family device packaging, labeling, or Quick Start Guide, those device-specific materials control solely with respect to regulatory and safety matters.
Lawful Use and Required Consent
You are solely responsible for using Safe Family features lawfully, including obtaining any consent, notice, or authorization required under applicable law before monitoring, tracking, receiving alerts about, or sharing another person’s location or other personal information.
Location History Retention
For Safe Family location features, the Application retains and displays places visited during the last 365 days. Greenlight deletes Safe Family location history after 12 months, subject to applicable law and the Privacy Statement.
Safe Family Alerts and Text Messages
We may offer you the option to receive SMS or text messages related to Safe Family monitoring features, sometimes on a recurring basis. We may also send SMS or text messages in the event of an emergency, such as detection of a significant motor vehicle collision. You agree that the mobile number you provided is true and accurate and that you are authorized to enroll the designated mobile number to receive such text messages. We are not responsible for delays in sending or receiving text messages.
Safe Family Service Limitations
The Safe Family services are not a substitute for parental supervision, emergency services, law enforcement, medical care, or your independent judgment. Greenlight makes no representation or warranty regarding the accuracy, timeliness, reliability, or completeness of any data or information provided by the Safe Family services, including location tracking, precise measurement of direction, distance, location, or topography, notifications, or other features.
Safe Family functionality depends on factors outside Greenlight’s control, including carrier coverage, internet connectivity, the Safe Family device being turned on, device battery level, device settings, permissions, environmental conditions, and other communication networks. The Safe Family services may not function without disruptions, delays, gaps in coverage, or other limitations.
Safe Family Subscription Start Date
Your Safe Family subscription begins on the earlier of: (1) the date you activate your Safe Family device; or (2) ten (10) days after the date of your order. Subscription fees begin accruing from the subscription start date regardless of when you complete device setup.
Standalone Subscriptions and Device Purchases
If you acquire a Safe Family device from a third party or secondhand, you may purchase a standalone subscription directly from Greenlight to access Safe Family features. Greenlight will make the process for purchasing a standalone subscription available to you through the Application or by contacting Greenlight customer support.
If you have an active Safe Family subscription and your device is lost, stolen, or damaged beyond repair, you may purchase a standalone replacement device by contacting Greenlight customer support. Greenlight may make additional purchase options available from time to time.
Purchases Through Amazon and Third-Party Resellers
If you purchase a Safe Family device through Amazon or another third-party reseller, your purchase is subject to that reseller’s applicable purchase, return, refund, shipping and warranty policies, not Greenlight’s Return Policy, Shipping Policy or Warranty Policy. Greenlight’s 30-day satisfaction guarantee and associated refund terms described in the Return Policy apply only to devices purchased directly through the Greenlight Store at shop.greenlight.com. For returns within the reseller’s standard return window, please contact the reseller directly. After that window closes, Greenlight’s Warranty Policy applies and warranty claims should be submitted directly to Greenlight. By activating a device purchased through a third-party reseller, you agree to these Terms and all incorporated policies with respect to your use of the Safe Family services, even where certain purchase-related policies do not apply to your device purchase.
29. Product-Specific Terms for Family Hub
These product-specific terms apply only to the Greenlight Family Hub device and related Family Hub services. In the event of a conflict between these product-specific terms and the general terms above, these product-specific terms control for the Family Hub device and services.
Family Hub Services
The Greenlight Family Hub is a dedicated smart home display available in 10.1-inch and 15.6-inch models, serving as a shared household command center for family schedules, chores, photos, safety, and more. The Family Hub runs a closed, family-safe platform with no app store, no browser, and no third-party distractions.
The Family Hub services include a free tier and a paid subscription tier (Family Hub Plus). Core features — including family calendar, photo display, chores, to-do lists, grocery lists, and star rewards — are available on the free tier at no charge. Additional features — including the safety map, AI voice assistant, and voice list management — require a Family Hub Plus subscription. Existing Greenlight subscribers may access Family Hub features through their current Greenlight plan if their plan includes those features.
If enabled, voice-enabled or AI-assisted Family Hub features may process voice commands and related inputs to provide requested functionality. Parents and legal guardians are responsible for determining whether those features are appropriate for child users and for disabling those features if they do not want such processing to occur.
You represent that you have all rights, permissions, and consents necessary to upload, sync, display, share, or otherwise make available through the Family Hub services any photos, calendar information, voice inputs, contact information, location information, or other content or information relating to yourself, any child, or any other person.
Family Hub Device Variants and Regulatory Compliance
The Family Hub is available in two hardware variants: a 15.6-inch model and a 10.1-inch model. These variants differ in hardware configuration, power source, battery type, and applicable regulatory requirements.
The Family Hub device complies with Part 15 of the FCC Rules. Operation is subject to the following two conditions: (1) the device may not cause harmful interference; and (2) the device must accept any interference received, including interference that may cause undesired operation. Changes or modifications not expressly approved by Greenlight could void your authority to operate this equipment. The FCC ID applicable to your device is printed on the device label and in the Quick Start Guide included with your device. The device should be operated with a minimum distance of 20 cm between the device and any part of your body.
Power and Battery
The Family Hub 15.6-inch model is AC powered via USB-C and does not contain an internal rechargeable battery. The device must remain plugged in during use.
If your Family Hub model or any included accessory contains a coin cell or button battery, keep new and used batteries out of reach of children. A swallowed coin cell or button battery can cause serious injury or death in as little as two hours. Seek immediate medical attention if ingestion or insertion is suspected. Additional battery-specific warnings and instructions are provided on the product packaging and in the Quick Start Guide included with the applicable device or accessory.
The Family Hub 10.1-inch model contains a sealed rechargeable lithium-ion battery providing up to 4–6 hours of battery life. Do not expose the device to extreme heat or fire. Do not puncture or disassemble the device. Keep the device away from children. The lithium-ion battery in the 10.1-inch model is not a coin cell or button battery; the mandatory coin cell ingestion hazard warning under Reese’s Law does not apply to this model.
Quick Start Guide and Packaging Disclosures
The Quick Start Guide and product packaging accompanying your Family Hub device contain important regulatory, safety, and compliance disclosures specific to your device variant, including FCC compliance statements, battery safety warnings, manufacturer information, and country of origin. Please read all such disclosures carefully before using your device. In the event of any conflict between these Terms and those disclosures, the Quick Start Guide and packaging disclosures control with respect to device-level regulatory and safety requirements.
Family Hub Feature Limitations
Family Hub features depend on compatible hardware, power, internet connectivity, device settings, account setup, software and firmware updates, and, in some cases, third-party services or the Greenlight app. Any Family Hub safety map or location-related feature displays information provided through the Greenlight app and depends on the Greenlight app, user permissions, device settings, internet connectivity, and network availability. The Family Hub device itself does not provide independent GPS or cellular connectivity for those features.
Certain Family Hub features may require you to connect or authorize third-party services. By connecting a third-party service, you authorize Greenlight to access, use, and display information from that service solely as needed to provide the applicable Family Hub feature, subject to these Terms and the Privacy Statement. Greenlight is not responsible for third-party services or their availability, accuracy, performance, or terms, or for interruptions, delays, sync failures, or missing content caused by those services.
For Family Hub services, Greenlight may offer text messages, push notifications, or similar alerts relating to place alerts, arrival notifications, departure notifications, account activity, or other Family Hub features. The Family Hub device itself does not provide independent crash detection, GPS, or cellular service. Family Hub safety-related features, including the safety map and related alerts, are informational only and are not a substitute for emergency services, adult supervision, or your independent judgment.
Greenlight makes no representation or warranty regarding the accuracy, timeliness, reliability, or completeness of Family Hub features, including calendar synchronization, photo display or synchronization, notifications, AI assistant outputs, or other service features.
Family Hub Subscription Start Date
For Family Hub Plus annual plan subscribers, your paid subscription begins on the earlier of: (1) the date you activate your Family Hub device; or (2) thirty (30) days after the date of your order. For customers who receive a free trial of Family Hub Plus, your free trial begins upon device activation. Unless you cancel before the end of your free trial period, your subscription will automatically convert to a paid subscription as described in the Free Trials section above. Subscription fees begin accruing from the applicable subscription start date.
Standalone Subscriptions and Device Purchases
If you acquire a Family Hub device from a third party or secondhand, you may purchase a standalone Family Hub Plus subscription directly from Greenlight to access paid features. Greenlight will make the process for purchasing a standalone subscription available to you through the Application or by contacting Greenlight customer support.
